Membership & Visit Pass Terms and Conditions

(Rackley Swimming, City Aquatics & City Health Clubs)

1. Welcome

Welcome to Rackley Swimming, City Aquatics and City Health Clubs, operated by City Venue Management (CVM).

We look forward to supporting you on your health and fitness journey.

Before entering into a membership or purchasing a visit pass, please read these Terms and Conditions carefully. They set out your rights and obligations. Only sign up if you understand and agree to them.

If there is any inconsistency between verbal information and this document, these Terms and Conditions will prevail.

2. Definitions
  • “You / Your” means the member or visit pass holder named on the application.

  • “We / Us / Our” means City Venue Management (including Rackley Swimming, City Aquatics and City Health Clubs).

  • “Facility” means the CVM venue(s) your membership or visit pass allows access to.

  • “Membership Commencement Date” means the date your membership starts.

  • “Ongoing Membership” means a flexible membership that continues until cancelled in accordance with these Terms.

  • “Membership Fee” means the fees payable for access to facilities and services.

3. Conditions of Entry

To maintain a safe, welcoming environment, you must comply with these conditions. Failure to do so may result in suspension or termination of your membership or visit pass.

Behaviour

Entry may be refused or you may be asked to leave if you:

  • Use abusive, threatening or intimidating language or behaviour

  • Are under the influence of drugs or alcohol

 

Smoke-Free Facilities

All CVM facilities are smoke-free and vape-free zones. Smoking or vaping is prohibited within facilities and within 5 metres of any entrance or boundary.

Clothing & Hygiene

  • Appropriate, non-offensive clothing must be worn at all times

  • Covered sporting footwear is required in health club areas

  • Towels must be used on equipment and equipment wiped down after use

  • Appropriate swimwear is required in aquatic areas

Pool Use

  • Observe lane signage and swim to the left when sharing lanes

  • Follow all pool rules and lifeguard instructions

Health Club & Training Zones

  • Scan in on each visit using your access card

  • Return equipment after use and wipe down machines

  • Memberships are strictly non-transferable

Personal Training

Only authorised and registered personal trainers may provide training services within CVM facilities. Unauthorised training may result in suspension or termination.

4. Membership Types

All memberships are ongoing and flexible, with 28 days’ written notice required to cancel.

City Swim

  • Access to CVM pools and lap swimming

  • Ongoing membership

  • Current fee (Adult): $69.80 per 28 days

City Health

  • Access to CVM pools, health club, training zones and group fitness

  • Ongoing membership

  • Current fee (Adult): $89.75 per 28 days

City Performance

  • Access to CVM pools, health club, training zones, group fitness and adult squads

  • Ongoing membership

  • Current fee (Adult): $109.70 per 28 days

City CrossFit

  • Available at Hibiscus only

  • Ongoing membership

  • Single-site access only

Visit Passes

  • Valid only at the facility purchased

  • Maximum validity: 12 months

  • Unused visits expire and are not refundable, except where required under Australian Consumer Law

5. Cooling-Off Period

You are entitled to a 7-day cooling-off period from the date you sign up.

You may cancel within this period by providing written notice. If you do, all fees paid will be refunded, and the agreement will end when notice is received.

6. Fees, Payments & Price Changes
  • Membership fees must be paid via direct debit or upfront payment

  • Failure to use facilities does not relieve payment obligations

  • A $5 fee applies for failed direct debit payments

  • A $0.39 direct debit processing fee and applicable card surcharges may apply

Fee Increases

We may increase membership fees for reasonable commercial reasons.
 At least 14 days’ written notice will be provided.

If you do not accept the increase, you may cancel your membership without penalty by giving written notice within the notice period.

7. Joining Fee

A $10 joining/activation fee applies to all new memberships.

This fee covers account setup and onboarding and is non-refundable, except where you cancel during the cooling-off period or where required under Australian Consumer Law.

8. Suspension / Hold
  • Memberships must be paid up to date to be suspended

  • Requests must be submitted in writing at least 14 days in advance

  • Maximum suspension: 90 days per calendar year

  • Minimum suspension period: 14 days

  • Fee: $0.50 per day

  • Suspensions are not retrospective and cannot be backdated

9. Termination

By You

You may cancel your membership at any time by providing 28 days’ written notice.
 No exit fees apply.

Medical Termination

You may terminate your membership immediately by providing written notice and a medical certificate from a qualified medical practitioner confirming that you are unable to participate in exercise for an extended period.

Paid-in-full memberships are not refundable, except where required under Australian Consumer Law.

By City Venue Management

We may suspend or terminate your membership if you:

  • Breach these Terms and Conditions

  • Breach the Conditions of Entry

  • Are the subject of a serious complaint

Any refund entitlement will be assessed in accordance with Australian Consumer Law.

10. Transfer of Agreement

We may assign or transfer this agreement provided it does not reduce your rights or increase your obligations. Reasonable notice will be provided.

Facilities may relocate within a 10 km radius.

11. Changes to Services & Facilities

We may vary operating hours, programs, services or amenities for operational or seasonal reasons.

We will not make changes that materially reduce core membership services without providing reasonable notice and an option to cancel without penalty.

12. Access Cards
  • One access card per member

  • Lost or damaged access cards must be reported as soon as reasonably practicable

  • A $5 replacement fee applies

  • Cards must not be shared

Sharing cards may result in suspension or termination. Any refund entitlement will be assessed under Australian Consumer Law.

13. Age Requirements
  • Minimum age for Health Club / Training Zone membership: 14 years

  • Members under 16 must be directly supervised by a parent or guardian member at all times

  • Under-16s are restricted to cardio, functional and pin-loaded equipment

  • Mandatory induction required for all under-16 members

14. Equipment Use & Health

You are responsible for using equipment correctly. Seek staff assistance if unsure.

You warrant that you are physically able to participate in exercise. If unsure, seek medical advice before commencing. You are responsible for informing us of any material change to your health condition that may affect your ability to exercise safely.

15. Liability & Consumer Rights

Nothing in this agreement excludes, restricts or modifies your rights under Australian Consumer Law.

To the extent permitted by law, CVM is not liable for loss or damage not caused by our negligence.

16. Entire Agreement & Severability

These Terms and Conditions constitute the entire agreement. If any part is found unenforceable, the remainder will continue to apply.

17. Direct Debit Agreement

Direct debit payments are processed by DebitSuccess Pty Ltd (ACN 095 551 581) as our agent.

You authorise DebitSuccess to debit your nominated account in accordance with your Direct Debit Request and these terms. DebitSuccess does not provide fitness services and is not responsible for service delivery.

Failed payments may incur a $5 fee plus any applicable bank fees.

Acknowledgement

By signing up, you acknowledge that you have read, understood and agree to these Terms and Conditions.

How the Promotion Works

Current Member Reward: Current City Health Club members who successfully refer a new member will receive two (2) weeks free on their active membership.

New Member Reward: The new member will also receive two (2) weeks free on their eligible membership.

Eligibility

To qualify for the promotion:

  • The referring person must be an active City Health Club member at the time the new membership is purchased.
  • The new member must be a new member or have not held a City Health Club membership within the previous 90 days.
  • The new member must sign up to an eligible City Health, City Performance or Adult Squad membership for a minimum of  weeks. 
  • Casual memberships and City Swim/Swim Only memberships are excluded.
  • The new member must provide the referring member’s full name at the time of joining. Referrals cannot be added retrospectively.
  • Standard pre-exercise screening and membership requirements apply.

Reward Application

  • Visit Reception to redeem.
  • The two weeks free will be applied as a credit to each eligible member’s account after the new member has successfully joined and their first direct debit payment has been processed (or upfront payment has been received).
  • Credits may be used to offset future membership payments.
  • Credits cannot be redeemed for cash, transferred to another person or applied to another membership.
  • Any unused credit is forfeited if the membership is cancelled.

Additional Conditions

  • There is no limit to the number of friends an eligible member may refer during the Promotion Period.
  • Members may receive multiple rewards, with two weeks free awarded for each successful eligible referral.
  • Join fees, access fees and any applicable pro-rata fees remain payable unless otherwise advertised.
  • City Venue Management reserves the right to refuse or cancel referrals where fraudulent, duplicate or self-referrals are identified.

  4. This Promotion is open to new members aged 16 years or over who meet the eligibility requirements of the applicable membership agreement. Concession memberships require valid proof of concession eligibility.
  5. Eligible memberships include City Health, City Performance and Adult Squad memberships on a 12-month direct debit agreement or 12-month upfront membership unless otherwise specified.
  6. The referring member must hold an active membership in good standing at the time the new member joins and when the referral reward is processed.
  7. The referring member’s details must be supplied by the new member during the sign-up process. Referrals cannot be claimed after the membership has been processed.
  8. Promotion rewards are not transferable, exchangeable or redeemable for cash and cannot be used in conjunction with any other offer unless expressly stated.
  9. City Venue Management reserves the right to verify the identity and eligibility of all participants. Incomplete, false, fraudulent or non-compliant referrals will be deemed invalid.
  10. City Venue Management reserves the right to amend, suspend or cancel the Promotion at any time where circumstances beyond its reasonable control affect the administration of the Promotion, subject to applicable laws.
  11. City Venue Management’s decision in relation to all aspects of the Promotion is final and no correspondence will be entered into.
  12. By participating in the Promotion, entrants consent to City Venue Management using their name, image and/or likeness for promotional purposes without compensation unless otherwise prohibited by law.
  13. Participants release and indemnify City Venue Management, its employees and agents from any claims, loss or liability arising from participation in the Promotion, except where liability cannot be excluded by law.
  14. Unless otherwise stated, all memberships purchased under this Promotion remain subject to the standard City Health Club Membership Terms and Conditions, including applicable cancellation notice periods and membership policies.

The complimentary PT session is not available at City Training Zone locations and must be used within the first 30 days of membership. This offer is available for new or returning members (existing members are ineligible) on 6-month minimum term contracts or 12-month upfront memberships.

Promotion: Refer a Friend – 2 Weeks Free

Promotion Dates: From 12th August 2024 to 30th September 2024.

How the Promotion Works

Current Member Reward:

  • Current members receive two weeks free for every new member they refer.

New Member Requirements:

  • The new member must sign up for an “Up Front” 12-month membership or a 6-month contract.
  • The new member must provide the name of the referring client during sign-up.

Validation Process:

  • The current City Health member must be validated in our client systems.
  • If the referring client cannot be validated, the new member will not be eligible for the two weeks free.

Free Weeks Award:

  • Both the new and referring member will receive two weeks of free access based on their chosen membership type.
  • The free weeks will be applied as an account adjustment, which may clear any pro-rata charges or be used as a future credit towards the next direct debit.
  • The join fee still applies.

Overpayment Policy:

  • The value of the overpayment is determined by the two-week price of the active membership.
  • Overpayments cannot be refunded in cash or transferred to a different membership.
  • If a member cancels before using the credit, the credit is forfeited.

Competition Period:

Entries close at COB (Close of Business) on September 9th, 2024 9:00 PM AEST and September 14th, 2024 9:00 PM AEST for Boonah Pool, Canungra Pool, Hibiscus Leisure Centre and Tamborine Mountain Pool.

Terms:

Only one membership prize per winner.

Only one entry per participant.

One winner will be selected per venue.

Winners can redeem their prize at any participating Rackley Swimming, City Aquatic, or City Health Club (including City Training Zones) location. 

Selection of Winners:

Winners will be randomly selected using an online random picker.

Selected winners will be notified via the contact details provided at entry and will have one week (7 days) to accept their prize.

Prizes may be transferred to family or friends but cannot be redeemed for cash or used to pay any previous or current debts.

Prize Redemption:

The prize is a 3-month free membership which can be redeemed during the months of September, October, November, or December 2024, for a total of 90 days free.

If the free period coincides with a holiday closure, the free membership period will be extended accordingly.

Free membership must be redeemed in full by January 31st, 2025.

Customers are not obligated to enroll beyond the free period but must follow City Health or Rackley Swimming’s cancellation policies to cancel their membership if they do not wish to continue.
